Fines up to $10,000: two more US states put a total ban on crypto

The states of Delaware and New Jersey have banned possession, installation, and operation of cryptocurrency (Bitcoin ATM) citing high fraud risks. Violations are subject to fines of up to $10,000. Delaware has also restricted the conversion of fiat-to-cryptocurrency transactions that "mimic or substitute" for ATMs, including point-of-sale systems and cash registers. The bill’s proponent in Delaware, Cindy Romer, emphasized that conventional traders do not use cryptotomates due to fees of up to 20% (compared to 0.4-1% on exchanges), and such devices often become an instrument of extortion from vulnerable populations.

According to the FBI, in 2025, law enforcement agencies recorded more than 13,400 cases involving crypto-fraud, and victims' losses exceeded $388 million, a 58% increase from the previous year. Delaware and New Jersey joined Indiana (March), Tennessee (April) and Minnesota (May), which have already imposed similar bans. Individual counties of California and Massachusetts are also considering restricting the operation of Bitcoin ATMs. Amid regulatory pressures, crypto operator Bitcoin Depot filed for bankruptcy in May.
