The Swiss Financial Market Supervisory Authority (FINMA) has approved the country's first spot Bitcoin exchange-traded fund aimed at individual investors. The new product will allow direct investment in the leading cryptocurrency and will operate under Swiss investment fund regulations. The name of the fund and the company that will issue it have not yet been announced.
Previously, Swiss platforms offered exchange products linked to Bitcoin and Ethereum. However, most of these instruments were legally structured as debt obligations. The approved fund, on the other hand, is subject to the regulations of mutual investment funds. This structure imposes additional obligations regarding asset custody, operational risks, investor information, and sales conduct standards.
FINMA explained the exception from the general requirement for investment diversification. The regulator noted that Bitcoin has a longer transaction history and significantly higher market capitalization compared to most other cryptocurrencies. This allows the fund to focus directly on Bitcoin rather than distributing funds among different assets.
The regulator noted that it does not share confidential information with institutional investors. Meanwhile, other fund providers have also submitted applications to create Bitcoin funds or announced plans to do so. Therefore, approval does not mean that the product will immediately start trading on exchanges.
FINMA emphasized that the decision does not eliminate the risks associated with investing in Bitcoin. The fund's documents will need to clearly explain price volatility, custody issues, and operational risks. According to the regulator, investors may lose a significant portion of their investments due to sharp fluctuations in Bitcoin's price.
